Terms of Service
The ContentForge Inc.
Last updated: 10/22/2026
These Terms of Service (the "Terms") are a contract between The ContentForge Inc., a Delaware corporation ("ContentForge", "we", "us"), and the business that creates an account ("Agency", "you"). They cover the website at https://the-contentforge.com, the application at https://contentforge-agency.com, and everything inside it, including Mount Olympus, Zeus, the client portal, The Pantheon, Business Hub, Chronos Booking, the prospect tool, our API and our MCP server (the "Services").
By creating an account, starting a trial or using the Services, you agree to these Terms on behalf of your business, and you confirm you have authority to do so. If you don't agree, don't use the Services.
Our Privacy Policy and Data Processing Addendum [link to come] are part of these Terms.
1. Definitions
- Agency: the business that holds the ContentForge account and pays for it.
- Team Members: people the Agency invites to its account.
- Client: a business the Agency adds to its account and works for.
- Client Users: people the Agency (or its Client) invites to a client portal or Business Hub.
- End Customers: a Client's customers, leads, contacts and website visitors.
- Customer Data: all data, content and materials you, your Team Members, Clients or Client Users put into the Services or collect through them, including Google data you connect.
- Credits: units used to pay for certain tasks inside the Services.
- Usage Balance: the prepaid dollar balance that pays for metered Pantheon usage (texts, calls, phone numbers, email and Assistant replies).
- Hosted Site: a Mount Olympus site that is published.
- Output: content, designs, recommendations or other results Zeus produces for you.
2. Accounts
- Business use only. The Services are for businesses. You must be at least 18 and able to form a binding contract.
- Accurate information. Keep your account, billing and agency details accurate and current.
- Security. You are responsible for everything done under your account, by your Team Members and by API keys and AI-assistant connections you create. Keep passwords and keys secret, use two-step verification (we strongly recommend requiring it for your team), and tell us at once at support@the-contentforge.com if you suspect unauthorized access.
- Roles. The Agency's Owner controls the account. Owners and Admins can invite and remove Team Members, change permissions, change the plan and connect Google.
- One trial per business. Each card can be used for one free trial. Creating extra accounts to get more trials or credits is not allowed.
3. Clients, client portals and Business Hub
- You manage your Clients. You decide which Clients to add, what they see and what each Client User can do. You are responsible for your Clients' and Client Users' use of the Services as if it were your own.
- Your agreement with your Clients is yours. We are not a party to it. You are responsible for your pricing, contracts, support and any promises you make to Clients, including about results.
- Authority over Clients' accounts. You confirm that you have your Client's permission to manage their website, domains, Google accounts and Business Profile, to send messages for them, and to process their End Customers' data through the Services.
- White-label. On plans that include it, you may present the client portal, editor, Business Hub, emails and reports under your own brand and domain. You may not claim that you built the underlying software, remove our notices from the legal pages, or rename Zeus.
- Clients don't contract with us. Client Users use the Services under your account and these Terms. If your account ends, their access ends too (see section 16).
4. Plans, trials and payment
- Plans. ContentForge offers Starter, Growth and Agency plans, billed monthly or annually. Current prices, monthly Credits, Zeus editor allowances and per-site hosting prices are shown in the app under Billing & credits. Prices can change; we will give account owners at least [30] days' notice of a price increase, which applies from your next renewal.
- Free trial. A trial with a card lasts 14 days. Nothing is charged until the trial ends; then your plan starts automatically unless you cancel first. We email the Owner 3 days before. Invitation trials without a card don't renew automatically.
- Hosted Sites. Drafts are free. Each Hosted Site is billed at your plan's per-site price on the same billing day as your plan. Publishing a site mid-period charges the rest of that period straight away. Unpublishing does not refund the current period.
- Payment. You authorize us (through our payment processor) to charge your payment method for all fees when due. Fees are in US dollars and exclude taxes, which you pay where applicable.
- Failed payments. If a payment fails, we will email you and retry. If it isn't paid within [14] days, we may limit or suspend the Services (including taking Hosted Sites offline) until it is paid.
- Cancellation. You can cancel any time from Billing & credits. Your plan and Hosted Sites stay active until the end of the period you've paid for and then stop. Canceling does not delete your account.
- No refunds. Fees already paid are not refundable. This covers subscription fees (including partial periods and unpublished sites), Credits (plan Credits and Credit packs) and Usage Balance. The only exceptions are where the law requires a refund, Credits returned automatically for a failed task (section 5.4), and problems ContentForge caused, such as a billing error or an outage or defect attributable to us; in those cases we may, at our discretion, give a refund, Credits or account credit. To raise one, email support@the-contentforge.com within [30] days of the charge or problem.
5. Credits
- What Credits pay for. Certain tasks use Credits (for example Zeus writing a page, creating an image, or a live map scan). The price is shown on the button, or in a confirm step, before you start. The current price list is in the app under What things cost. We may change Credit prices; the price shown when you start a task is the price you pay.
- Plan Credits refill each month on every plan (including annual plans) when your invoice is paid. Unused plan Credits don't roll over.
- Credit packs you buy never expire, including after you cancel, but they can only be used while you have an account.
- Failed tasks. If a paid task fails, its Credits are returned automatically.
- Running out. A task won't start without enough Credits. A job that has already started finishes; if it takes your plan Credits below zero, the difference comes off your next refill.
- No cash value. Credits are a license to use features, not money or property. They can't be sold, transferred between accounts, or exchanged for cash, and are not refundable except as described in section 4.7.
6. The Pantheon Usage Balance
- Prepaid. Metered Pantheon usage (texts, picture messages, calls, phone numbers, carrier registration fees, email and Assistant replies) is paid from a prepaid Usage Balance that is separate from Credits. You can add funds and turn on automatic top-up and low-balance alerts.
- Rates. Current rates are shown in the app. Carrier and registration fees set by third parties may change at short notice and are passed on.
- When the balance runs out. If the Usage Balance falls below [-$25], all chargeable usage stops (including incoming metered usage) until you add funds. Free features keep working.
- Rebilling your Clients. You may choose per Client to absorb usage or rebill it through your own payment account (at cost on Growth, with your own markup on Agency). You are the seller to your Client for those charges and responsible for your pricing, invoices, taxes and collecting payment. Your obligation to pay us doesn't depend on whether your Client pays you.
- No refunds. Usage Balance is not refundable, including on account closure, except as described in section 4.7 (where the law requires it, or where ContentForge caused the problem, at our discretion).
7. Zeus and Output
- You review before it goes live. Zeus produces drafts, recommendations and changes for you to check. Sites open as drafts; Google Business Profile posts and changes wait for approval; Google Ads campaigns are created paused. You are responsible for reviewing Output and for anything you publish, send or apply.
- No guaranteed results. Search rankings, traffic, leads and ad performance depend on many things outside our control. We do not guarantee any result from Output or from following Zeus's recommendations, and estimates (for example, estimated wasted ad spend) are estimates.
- Accuracy. Zeus is designed not to invent prices, reviews, statistics or quotes, but Output can still contain mistakes. Check facts, legal claims and anything regulated (for example health, finance, legal, licensing) before publishing.
- Ownership of Output. As between you and us, you own the Output created for you, to the extent the law allows, subject to these Terms. Similar Output may be produced for other customers.
- Third-party content. When you give Zeus sites you like or screenshots, he takes style cues only. You are responsible for having the right to any content, photos, logos or designs you upload or import.
8. Your data and content
- You own Customer Data. You grant us a worldwide, non-exclusive license to host, copy, process, transmit and display Customer Data only as needed to provide, secure and support the Services, and as described in our Privacy Policy.
- Your responsibilities. You are responsible for Customer Data: that you have the rights and consents needed to collect and use it, that it is accurate, and that it doesn't break the law or these Terms. You must give End Customers any privacy notices the law requires (Mount Olympus includes legal page and cookie banner tools, but the content and settings are your responsibility).
- Processor role. For personal information in Customer Data we act as your processor/service provider under our Data Processing Addendum.
- Export. You can export sites and much of your data from the app at any time.
- Feedback. If you send us ideas or feedback, we may use them without obligation to you.
- Aggregated data. We may use aggregated, de-identified data about use of the Services to run and improve them, as long as it does not identify you, your Clients or any person, and subject to the Google data restrictions in our Privacy Policy.
9. Acceptable use
You will not, and will not let anyone else, use the Services to:
- break any law or regulation, or infringe anyone's intellectual property, privacy or publicity rights;
- send spam, unsolicited bulk messages, or messages without the consent the law requires (see section 11);
- publish or send content that is fraudulent, deceptive, defamatory, harassing, hateful, sexually explicit involving minors, or that promotes violence;
- host sites for illegal products or services, phishing, malware, or content prohibited by carriers for texting (for example cannabis, illegal drugs, high-risk lending, and the other categories carriers prohibit);
- post fake reviews, impersonate a person or business, or create Business Profiles, citations or listings for a business you aren't authorized to represent;
- scrape, crawl or overload the Services, or use the prospect tool or audits to attack or overload third-party websites;
- probe, scan or test the security of the Services without our written permission, or get around usage limits, Credit charges or access controls;
- reverse engineer the Services, or copy them to build a competing product;
- resell or sublicense the Services except as allowed for your Clients under these Terms;
- use Google, carrier or other third-party services through ContentForge in breach of their terms.
We may remove content, pause messaging, or suspend accounts that break this section (see section 16).
10. Third-party services
- Connected services. The Services work with third-party services you choose to connect, such as Google (Search Console, Analytics, Google Ads, Business Profile, Sheets, Calendar), Figma, HubSpot, Mailchimp, payment accounts, domain registrars and AI assistants. Your use of them is governed by their own terms and policies. You must have the right to connect each account and to let us act on it as you direct.
- Google. By connecting Google you also agree to follow the Google terms that apply to the products you use (for example the Google Ads Terms and Google Business Profile policies). Our use of Google data is described in our Privacy Policy and follows the Google API Services User Data Policy, including the Limited Use requirements. Changes we make in Google (such as applying Ads fixes or publishing posts) happen only when you or your authorized users choose them.
- Availability. We are not responsible for third-party services, their availability, their changes to their APIs or policies, or their acts. If a third party limits or ends our access, related features may change or stop.
- Payments for your Clients (Chronos Booking). Online booking payments are made through a payment account in the business's own name with our payment processor, which is the business's contract with that processor. The business is the seller of record and responsible for its prices, refunds, chargebacks, taxes and disputes.
- Domains. You are responsible for domains you connect, their registration and their DNS settings.
11. The Pantheon messaging and calling compliance
This section applies when you or your Clients use The Pantheon to send texts, emails, make or record calls, or run automations.
- You are the sender. You (and the Client business whose number or domain is used) are the sender of every message and caller on every call. ContentForge provides the technology. You are solely responsible for complying with all laws and rules that apply, including the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, the CAN-SPAM Act, state "mini-TCPA" and telemarketing laws, Canada's CASL, and carrier rules including the CTIA Messaging Principles and Best Practices and 10DLC and toll-free verification requirements.
- Consent. Before texting or calling any person, you must have the consent the law requires (for marketing texts, prior express written consent), keep a record of it, and be able to show it to us or a carrier on request. You must not buy, rent or share contact lists for texting.
- Opt-outs. You must honor STOP and other opt-out requests immediately. ContentForge processes STOP keywords automatically; you must not remove, hide or work around this. You must honor email unsubscribes, and every marketing email must include a working unsubscribe link and your business's physical address.
- Quiet hours. You must follow the time-of-day limits for calls and texts in the recipient's time zone and any state that sets stricter hours.
- Registration. Each business that texts must be registered with carriers (10DLC brand and campaign, or toll-free verification) using its own true legal name, EIN and details. You confirm the information you give for registration is true and that you are authorized to register the business. ContentForge appears as the software provider on registrations. Registration fees are charged to your Usage Balance and are not refundable if a carrier rejects or suspends a registration.
- Call recording. Some states and countries require the consent of everyone on a call before it is recorded. If you turn on call recording or transcription, you are responsible for giving the required notice and getting the required consent (for example, a recorded announcement).
- Content. Messages must match the registered use case and must not include prohibited content (see section 9).
- The Assistant. If you turn on the Assistant, you are responsible for its knowledge base and for checking that its replies are appropriate. It answers only from the knowledge you give it and hands over to a person when unsure, but you remain responsible for messages sent in your business's name.
- Enforcement. Carriers can block numbers, suspend registrations or fine senders. We may pause or stop messaging or calling for any business immediately if we receive a complaint, a carrier notice, high opt-out or complaint rates, or believe this section is being broken. You will reimburse us for any carrier fines or penalties caused by your or your Clients' messaging.
- Emergency calls. The Pantheon is not a replacement for a telephone service for emergency calls. It does not support calls to 911 or other emergency numbers.
12. Prospect tool and leads
When you turn on Lead Capture on your prospect tool, you are the business collecting those leads. You must show any privacy notice required, and follow the law in contacting them. The prospect tool page does not name ContentForge; you are responsible for its content and branding.
13. API, MCP and AI assistants
You may use our API and MCP server to work with your account from other software, including AI assistants. You are responsible for the apps you connect and what they do with the data they receive, and for keeping keys secret. We may apply rate limits. Revoke a key or connection at any time in Settings → API & MCP.
14. Copyright complaints (DMCA)
We respect intellectual property rights and respond to notices of alleged infringement under the U.S. Digital Millennium Copyright Act (DMCA).
To report infringing material hosted on the Services (for example on a Mount Olympus site), send a written notice to our designated agent with:
- your physical or electronic signature;
- identification of the copyrighted work you say is infringed;
- identification of the material you say is infringing and where it is (for example the page address);
- your contact information (address, phone and email);
- a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent or the law; and
- a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act for them.
Designated agent: DMCA Agent, The ContentForge Inc., 1351 Brentwood Ave., Thermal, CA 92274, United States. Email: support@the-contentforge.com. [Registered with the U.S. Copyright Office, registration no. [NUMBER] — add once registered.]
Counter-notice. If your material was removed and you believe it was a mistake or misidentification, you may send a counter-notice with your signature, identification of the material and where it was, a statement under penalty of perjury that you believe it was removed by mistake or misidentification, your name, address and phone, and your consent to the jurisdiction of the federal court for your address (or, outside the U.S., any judicial district where we may be found) and to accept service from the person who sent the notice. We may restore the material after 10 to 14 business days unless the complaining party tells us they've filed a court action.
Repeat infringers. We will terminate the accounts of repeat infringers in appropriate circumstances.
15. Confidentiality
Each party may receive non-public information from the other. The receiving party will use it only to perform under these Terms, protect it with reasonable care, and not disclose it except to people who need to know it and are bound by similar duties, or as required by law. This doesn't apply to information that is public, already known, independently developed or rightfully received from someone else.
16. Suspension and termination
- By you. You can cancel your plan at any time (section 4.6). To close your account and have its data deleted, contact support@the-contentforge.com from the Owner's email address. We delete the account's data automatically within 30 days of the request, as described in our Privacy Policy.
- By us. We may suspend or terminate your account, or any part of the Services (for example messaging for one business, or one site), if you materially breach these Terms and don't fix it within [10] days of notice, if fees are unpaid, or immediately if needed to prevent harm, comply with law, or respond to a carrier, registrar or Google requirement.
- Effect. When your account ends, your access and your Client Users' access end, Hosted Sites go offline, and phone numbers may be released (port them out before you close your account if you want to keep them). Unused Credits and plan allowances end.
- Your data. For [30] days after your account ends you can ask us to let you export your data. After that, we delete Customer Data as described in our Privacy Policy, except where the law requires us to keep it.
- Survival. Sections on fees owed, Credits, data, confidentiality, disclaimers, liability, indemnity and governing law survive termination.
17. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We don't promise the Services will be uninterrupted, error-free or secure, that Output will be accurate, or that any search ranking, traffic, lead or advertising result will be achieved.
18. Limitation of liability
To the fullest extent the law allows:
- Neither party will be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data, even if told they were possible.
- Each party's total liability arising from these Terms or the Services will not exceed the amounts you paid us in the 12 months before the event giving rise to the claim.
- These limits do not apply to your payment obligations, your indemnity obligations, or a party's fraud or willful misconduct.
19. Indemnity
You will defend and indemnify ContentForge, its officers, employees and agents against third-party claims, and related losses and costs (including reasonable legal fees), arising from: Customer Data; your or your Clients' use of the Services; messages, calls or recordings sent or made through your account (including TCPA, CAN-SPAM and carrier claims); your agreements with your Clients; or your breach of these Terms or the law.
20. Changes to the Services and these Terms
We improve the Services all the time and may add, change or remove features. If we remove a major feature you pay for, we will tell you in advance where we reasonably can. We may update these Terms; for material changes we will notify account owners at least [30] days before they take effect. Continuing to use the Services after that means you accept the new Terms.
21. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, and both parties consent to their jurisdiction.
22. General
- Entire agreement. These Terms, the Privacy Policy, the Data Processing Addendum and any order form are the whole agreement about the Services.
- Assignment. You may not assign these Terms without our consent. We may assign them in a merger, acquisition or sale of assets.
- Force majeure. Neither party is liable for delays caused by events beyond its reasonable control, including outages of third-party providers and carriers.
- Notices. We send notices to the account Owner's email. Send notices to us at support@the-contentforge.com and The ContentForge Inc., 1351 Brentwood Ave., Thermal, CA 92274, United States.
- No waiver; severability. Not enforcing a term isn't a waiver. If a term is unenforceable, the rest stays in force.
- Independent parties. The parties are independent contractors.
- Export and sanctions. You will not use the Services in breach of U.S. export or sanctions laws.
